I have known this client since I was working at the law firm.  Soon after I started my practice on my own, I was retained to support their Work Permit extension application.  Although it is always a good idea to start the preparation of extension early, I understand the company may need to wait until the last minute to determine whether they need to extend their expatriate’s Work Permit or not.

I have to say that it is a rare case to receive a positive result within a week.  Having had this experience, I have a thought that IRCC may prioritize the case somewhat based on the expiry date of status.

Intra-Company Transferee Work Permit

This is a Work Permit for intercompany transfers that do not require a Labour Market Impact Assessment (LMIA). Executives, Managers, and Specialized Knowledge Workers positions are qualified to apply for this Work Permit.

General Requirements:

  • A multi-national company has a location (parent, a subsidiary, a branch, or an affiliate of that enterprise) in Canada and its business continues to be legitimate and stable.
  • Applicants have been employed continuously by the company outside Canada in a similar full-time position for at least one year in the three-year period immediately preceding the date of initial application.

【Executives and Managerial Position】

This category includes the person in an executive or managerial position in Canada. Primally plan, organize, operate, or manage a business.

【Specialized Knowledge Workers Position】

Applicants must process the following knowledge:

  • knowledge at an advanced level of expertise in products and services.
  • proprietary knowledge of the product or service and its application in international markets.
  • proprietary knowledge of the company’s processes and procedures such as its production, research, equipment, techniques, or management.
