New Rules for LMIA High-Wage Stream

Hello World! Today, we would like to share an important notice for Labour Market Impact Assessment (LMIA) based Work Permit applicants and employers.

The Government of Canada has announced latest changes to the LMIA in the High-Wage stream to further improve protections for foreign workers and prioritize employment opportunities for Canadian workers.

Changes to the High-Wage Stream

Effective October 28 and November 8, 2024, the following changes apply to LMIA applications in the High-Wage stream.

Increasing the Wage Threshold

November 8, 2024, the wage threshold to determine the High-Wage or Low-Wage streams will be 20% higher than the current median wage in the applicable province or territory. This is expected to result in a $5-8 increase in the hourly wage required for job offers, depending on the region.

Ex.) Wage Threshold in BC

For LMIAs received before November 8, 2024: $28.85

↓(Increase by 20%)

For LMIAs received as of November 8, 2024: $34.62

Enhancing Business Legitimacy Requirement

As of October 28, 2024, the *Attestation Letter, used by employers to prove the legitimacy of their business, can no longer be accepted for LMIA applications.

*Attestation Letter – A formal document prepared by a professional such as lawyers or chartered professional accountants to prove or confirm a particular fact, condition, or circumstance.

Changes to the Low-Wage Stream

For LMIA applications in the Low-Wage stream, stringent employer requirements are already in effect as of September 26, 2024.

As mentioned above, after November 8, 2024, employers will have to make job offers at higher wages than before when hiring foreign workers under the LMIA in the High-Wage stream.
