I have known Ms. M.M. for over three years, back when she was an international student. Her immigration status transitioned from a Study Permit to a Working Holiday Visa, and then she applied for an LMIA-based Work Permit. After that was approved, she proceeded to apply for Permanent Residency (PR). Over those years, a lot of Immigration laws have changed. I’m glad we were able to have a consultation early on and support her all the way through to obtaining PR in Canada.
LMIA-based Work Permit
Canadian employers who wish to hire foreign workers may need to obtain a Labour Market Impact Assessment (LMIA) before they can hire a foreign worker. If the employer receives a positive LMIA, the foreign worker can then apply for a Work Permit based on that LMIA. Once the permit is approved, the individual is legally allowed to work in Canada.
A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.
To obtain a positive LMIA, the employer must first conduct recruitment efforts and prove that no suitable Canadian citizens or permanent residents were available to fill the position. Foreign workers can only be hired when qualified local candidates cannot be found.
The employer is obligated to maintain compliance with the job offer such as positions, wages, working conditions and immigration laws associated with its LMIA.
Express Entry – Additional Points for LMIA Job Offer
On March 25, 2025, Immigration, Refugees and Citizenship Canada (IRCC) announced the removal of this point system for the Canadian Experience Class (CEC) category. As a result, current and future CEC candidates in the Express Entry pool no longer receive points based on the job offer. Please check our previous article for further information.
Before the change, applicants were eligible to receive additional points (50 points or 200 points) for a job offer supported by LMIA under Express Entry. This was a significant advantage when applying for permanent residency.
In the future, immigration laws may change again, and those with a job offer could be at an advantage. If there are any updates, we will post them on our blog.
