TFW Program: Enhance Compliance Regime
Hello World! Today we would like to share information about the Canadian government’s efforts to protect temporary foreign workers (TFWs) under Canadian Work Permits.
In June 2024, the Canadian government announced measures to enhance the compliance regime of the TFW Program, aiming to improve fairness in the labour market and protect foreign workers.
Background
While the TFW program continues to play an important role in the Canadian economy, some employers are not complying with the terms of the contracts, resulting in negative impacts on TFWs and the Canadian labour market.
Strengthening Compliance Regime
To ensure continued employer compliance, the Government of Canada is working to strengthen the employer compliance regime by implementing the following measures.
Strengthening Inspections & Penalties:
Inspections may be conducted to ensure employer compliance with program conditions, which may include noticed or unannounced visits to the workplace and interviews with employees, supervisors, and employers. Employers are required to provide documentation of compliance.
Last fiscal year, 2,122 inspections were conducted under the TFW program, confirming 94% compliance. During this period, $2.1 million in administrative penalties were imposed on employers who violated program rules, an increase of approximately 36% from the prior fiscal year.
Enhanced Reporting Tools:
The TFW program uses enhanced tools to help workers and other parties anonymously report situations of possible fraud or program misuse. This includes a confidential tip line with live agents available in multiple languages.
From April 1, 2023, to March 31, 2024, the Government of Canada assessed 8,426 tips, 57% of which resulted in an inspection being launched, informing an active inspection, or a referral being sent to an external partner.
Protecting Worker Rights & Education
The Government of Canada also supports outreach sessions to employer associations and consulates to promote awareness of the rights of TFWs and the obligations of employers.
